These Terms and Conditions (“Terms”) govern your access to and use of the website adriabim.com, including its language versions, operated by E-DISTI d.o.o., Litijska cesta 259, 1261 Ljubljana, Slovenia, VAT ID: SI72537094, Registration Number: 3792234000 (“E-DISTI”, “AdriaBIM”, “we”, “us”, or “our”). By accessing or using our website, creating an account, submitting an inquiry, registering for an event, or placing an order, you agree to be bound by these Terms in full. If you do not agree, you must not use the website.
Please read these Terms carefully before using our website, requesting a software trial, or purchasing event tickets. These Terms constitute a legally binding agreement between you and E-DISTI. By completing a purchase or registration, you confirm that you have read, understood, and accepted these Terms.
1. Definitions
“Website” refers to all web pages, content, and services available at adriabim.com and its language versions, operated by E-DISTI for the promotion and distribution of engineering and BIM software and for the AdriaBIM Academy.
“Software” refers to the third-party software products presented on the Website — including AxisVM, DICAD STRAKON, Virtual Steel, 3Muri, CYPE, SketchUp, IronCAD, Bentley Systems products, and others — which E-DISTI distributes as an authorised distributor or reseller.
“Publisher” refers to the software company that develops a given Software product and whose End User License Agreement (EULA) governs its use.
“Products” refers to the goods and services sold directly through the Website, which are limited to tickets and registrations for AdriaBIM Academy events.
“Events” refers to the trainings, webinars, and in-person or hybrid sessions organised under the AdriaBIM Academy brand.
“Customer”, “you”, or “your” refers to any individual or legal entity accessing the Website, submitting an inquiry, registering for an Event, or purchasing Products.
“Account” refers to the registered user profile created during checkout or via the registration process on the Website.
2. Eligibility
You must be at least 18 years of age to use this Website, create an Account, submit an inquiry, or place an order. By using the Website, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
If you are acting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
You may create an Account during the checkout process or via the registration form. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.
You agree to provide accurate, current, and complete information during registration and to keep your Account information up to date. E-DISTI reserves the right to suspend or terminate any Account that contains inaccurate information or is used in violation of these Terms.
Access to your support tickets does not require an Account — secure, personalised links are sent to your email address. You are responsible for keeping access to that email address secure.
You must notify us immediately at [email protected] if you become aware of any unauthorised use of your Account.
4. Software, Offers and Trials
E-DISTI is an authorised distributor and reseller of the Software presented on the Website. Software licenses are not sold directly through the Website. Product pages, trial requests, and inquiry forms serve to prepare a personal offer: after you submit an inquiry, our engineers contact you and any purchase of Software is concluded through a separate offer and agreement.
All Software is subject to the respective Publisher’s End User License Agreement (EULA), which governs your use of the software itself. License types, configurations, and limitations are described in the relevant offer.
Trial and demo versions of Software may be arranged free of charge for evaluation purposes. Trial versions are provided “as is”, may have limited functionality or a restricted evaluation period as specified for each product, and remain subject to the Publisher’s EULA.
5. AdriaBIM Academy Events and Tickets
The Website sells tickets and accepts registrations for AdriaBIM Academy Events — webinars, in-person trainings, and hybrid sessions. The date, time, location or online platform, programme, and price of each Event are stated on the relevant Event page.
Events may have a limited number of seats. Registrations and ticket purchases are accepted in the order received, up to the stated capacity.
Admission to a paid Event requires a valid ticket. A ticket may be transferred to another attendee — please notify us in advance at [email protected] so we can update the registration.
Events may be recorded. Recordings of the presentation may be published on the Website or on our channels; attendee cameras and microphones are not included in published recordings unless you actively participate on stage or ask questions during a recorded session.
6. Orders and Pricing
All prices displayed on the Website are in euros (EUR) and exclude VAT unless stated otherwise. Applicable VAT is calculated and added at checkout in accordance with current legislation.
Placing an order constitutes an offer to purchase. A binding contract is formed only when we confirm your order via email. We reserve the right to refuse or cancel any order for reasons including but not limited to Event capacity, pricing errors, or suspected fraud.
We make every effort to ensure pricing accuracy. In the event of a manifest pricing error, we will notify you and offer the option to confirm the order at the correct price or cancel it for a full refund.
7. Payment
Payment for Products is made by bank transfer (direct deposit to our business account). Payment instructions are provided at checkout and in the order confirmation email.
Your order is confirmed and processed upon receipt of funds. If payment is not received within 14 days of the order date — or before the start of the Event, whichever comes first — the order may be automatically cancelled.
Where additional payment methods are offered at checkout, their use may be subject to the respective payment provider’s terms and privacy policy.
8. Delivery
Event tickets and registrations are digital. Upon successful registration or confirmed payment, your confirmation — including the Event details and, for webinars, the joining link — is delivered electronically to the email address you provided.
No physical goods are delivered. If you do not receive your confirmation email, please check your spam folder and contact us at [email protected].
9. Right of Withdrawal
Under EU consumer protection law (Directive 2011/83/EU) and the Slovenian Consumer Protection Act (ZVPot-1), consumers generally have the right to withdraw from a distance purchase within 14 days without giving any reason.
Pursuant to Article 16(l) of Directive 2011/83/EU and the corresponding provisions of ZVPot-1, the right of withdrawal does not apply to services related to leisure activities where the contract provides for a specific date or period of performance. Tickets and registrations for AdriaBIM Academy Events scheduled for a specific date therefore cannot be withdrawn from once purchased.
This does not affect your rights in case of cancellation or rescheduling by us (see Section 10), and we will always try to find a fair solution — including transferring your ticket to another attendee or a future Event — if your plans change. Contact us at [email protected].
10. Event Changes and Cancellations
We may need to make reasonable changes to an Event — including changes to the programme, speakers, or venue, or moving an in-person Event online — and will inform registered attendees of material changes by email.
If we cancel an Event, you will be offered a full refund of the ticket price or, at your choice, a transfer of your ticket to a rescheduled date or a comparable Event. Refunds are issued using the same payment method used for the original purchase within 14 days.
Our liability in connection with a cancelled or changed Event is limited to the price paid for the ticket. We are not responsible for travel, accommodation, or other costs incurred in connection with attending an Event.
11. Support Services
E-DISTI provides customer support for the Software it distributes through the support portal on the Website. The scope, availability, and duration of support depend on the specific Software and support arrangement and are described in the relevant offer.
Support is provided during business hours and in the languages specified on the Website. E-DISTI reserves the right to modify support offerings, provided that any changes do not diminish the support services already agreed with existing customers for the duration of their active support term.
12. Contact Forms and Communications
The Website provides contact, inquiry, trial request, event registration, and support forms. By submitting a form, you consent to E-DISTI processing the information you provide for the purpose of responding to your inquiry and, where applicable, for customer relationship management.
Submitted data is processed in accordance with our Privacy Policy and may be stored in third-party systems (Brevo for email communications and Intrix CRM for customer management) that are used by E-DISTI to handle inquiries and maintain customer relationships.
13. Intellectual Property
All content on the Website — including but not limited to text, graphics, logos, images, software, and design — is the property of E-DISTI or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Website without prior written consent from E-DISTI, except as necessary for your personal, non-commercial use of the Website.
AxisVM, DICAD, STRAKON, Virtual Steel, 3Muri, CYPE, SketchUp, Trimble, IronCAD, Bentley, MicroStation, and other product names, logos, and trademarks shown on the Website are the property of their respective Publishers and are used by E-DISTI under authorisation.
14. Prohibited Conduct
When using the Website, you agree not to:
- Provide false or misleading information in forms, orders, or Account registration
- Use the Website for any unlawful purpose or in violation of applicable laws
- Attempt to gain unauthorised access to any part of the Website, other user accounts, or our systems
- Interfere with or disrupt the operation, security, or integrity of the Website
- Use automated tools, bots, or scrapers to access the Website without prior written consent
- Share webinar joining links or gated recording access publicly or with persons who have not registered
- Resell or redistribute Event tickets commercially without our express authorisation
15. Limitation of Liability
To the maximum extent permitted by applicable law, E-DISTI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or in connection with your use of the Website, participation in Events, or evaluation of Software.
Our total liability for any claim arising from these Terms or your use of the Website shall not exceed the total amount paid by you to E-DISTI for the specific Product or service giving rise to the claim in the 12 months preceding the event.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
16. Disclaimer
The Website and all Products are provided “as is” and “as available” without warranties of any kind, except as expressly stated in these Terms or as required by mandatory applicable law.
E-DISTI does not warrant that the Website will be uninterrupted, error-free, or free of harmful components. We make reasonable efforts to ensure the accuracy of product descriptions, Event details, and pricing but do not guarantee that all information is complete or current at all times.
As a distributor, E-DISTI does not develop the Software presented on the Website and is not responsible for defects, bugs, or limitations inherent to the Software. Software-related warranties, if any, are governed by the respective Publisher’s EULA. Content presented at Events is for professional information and training purposes and does not constitute engineering advice for any specific project.
17. Third-Party Services
The Website may contain links to third-party websites or integrate third-party services (including video platforms, analytics, and communication platforms). E-DISTI is not responsible for the content, privacy practices, or terms of any third-party services.
Your use of third-party services is at your own risk and subject to the respective third party’s terms and conditions.
18. Termination
We may suspend or terminate your access to the Website or your Account at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.
Upon termination, your right to use the Website ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — shall remain in effect.
Termination of your Account does not affect the validity of Event tickets already purchased, unless the termination results from your abuse or violation of these Terms.
19. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.
In accordance with EU Regulation No 524/2013, consumers resident in the European Union may submit complaints via the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Our email address for ODR purposes is [email protected].
20. Changes to These Terms
E-DISTI reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Material changes will be communicated via email or a prominent notice on the Website.
Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Website.
21. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
